A little about

DP Cloud LLC

DP Cloud LLC was born from the volunteer fire service. In an effort to streamline and digitize certain functions, we built a suite of apps to support various operations of volunteer fire departments from fundraising, to daily operations and more. Mainstream apps were either too expensive, too clunky, or unusable for one reason or the other.

Sometimes small businesses or groups have a unique custom need for the internal and external apps they use. That's where we come in. We believe no two apps nor no two needs are the same. Sometimes, cookie cutter just won't do.

Thank you for choosing Command Bridge by DP Cloud LLC! These Terms of Service (“Terms”) govern your access and use of our app. Please read these Terms carefully before using the app. By using the app, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the app. Going forward the website, webapp, or app shall be known as one in the same and referred to as the “app”.

1. License and Use of the App:
   

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the app for your personal, non-commercial use.

2. User Content:

You are solely responsible for any content that you upload, post, or otherwise transmit through the app (“User Content”). By submitting User Content, you grant us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in any media or format.

3. Prohibited Conduct:

You agree not to engage in any of the following conduct in connection with your use of the app:

• Use the app for any illegal or unauthorized purpose;
  
• Post or transmit any User Content that is infringing, libelous, defamatory, obscene, pornographic, abusive, or otherwise offensive;
  
• Interfere with or disrupt the app or the servers or networks used to provide the app;
  
• Use any automated means to access the app;
  
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
  
• Intentionally or unintentionally violate any applicable local, state, national, or international law or regulation.
  
• Disclose information contained in the app to unauthorized parties
  
• Attempt to circumvent any security feature, logins, or gain access to areas of the app that are not explicitly granted access to.
  

4. Intellectual Property:

All content and materials available through the app, including without limitation, text, graphics, logos, images, and software, are the property of the app or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, copy, modify, distribute, or create derivative works based on any such content or materials without our prior written permission.

5. User-Submitted Content Disclaimer:

By accessing or utilizing our services, you acknowledge and agree that any information provided or submitted by users through the application may be inaccurate or erroneous. While we strive to maintain the accuracy and reliability of the content available on our platform, we cannot guarantee the correctness or completeness of user-submitted information.

You understand and accept that reliance solely on the information provided by other users is done at your own risk. We strongly advise exercising caution and independently verifying any critical data or information obtained through the application.

Furthermore, you agree that we bear no responsibility or liability for any damages, losses, or adverse consequences arising from the use or reliance on inaccurate or incomplete user-submitted content. We disclaim all warranties, express or implied, regarding the accuracy, reliability, or suitability of any information provided by users within the application.

It is your responsibility to verify the accuracy of any information obtained through the application and to use your judgment and discretion when making decisions based on such information.

By using our services, you agree to release us from any claims, demands, or liabilities arising out of or related to the accuracy or reliability of user-submitted content. This disclaimer shall apply to the fullest extent permitted by applicable law.

6. Disclaimer of Warranties:

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

7. Limitation of Liability:

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.

8. Indemnification:

You agree to indemnify and hold us and our affiliates, officers, agents, employees, and licensors harmless from any claim or demand, including reasonable attorneys’ fees, made by you or any third party due to or arising out of your breach of these Terms, your violation of any law or the rights of a third party, or your use of the app or service.

9. Termination:

We may terminate your access to the app at any time for any reason, without notice to you. In such a case, a prorated refund may be applied if the termination was not due to any breach of these Terms.

10. Governing Law and Jurisdiction:

These Terms shall be governed by and construed in accordance with the laws of New Jersey. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New Jersey.

11. Changes to These Terms:

We may update these Terms from time to time. If we make any material changes, we will post an updated Terms in the app and on our website.

This Privacy Policy explains how we collect, use, and disclose your personal information in connection with the app. Going forward the website, webapp, or app shall be known as one in the same and referred to as the “app”.

Information we collect:

• We do not automatically collect any data and transmit it off your device in a way that allows us and/or a third-party partner to access it for a period longer than necessary to service the transmitted request in real time.
  
• Information you provide: When you use our app, we only collect personal information that you manually provide to us in the context of using the app for its purpose of contact sharing. This information may include your name, email address, and phone number but only what you have consciously, proactively and manually shared. You are solely responsible for any content that you upload, post, or otherwise transmit through the app (“User Content”). By submitting User Content, you grant us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in any media or format.
  
• Usage information: We may collect information about the most recent login date and time for your login credential. Usage history is not collected.
  
• Device information: We may access information locally about the device such as current location, the type of device, operating system, and device settings in order to alter the appearance of the app on screen or to provide you with real time information. This information is only used locally on your device to process your real time request and is not collected or logged server side.
  

How we use your information:

• To provide the app: We use your personal information to provide you with access to the app and its features.
  
• To communicate with you: We may use your personal information to communicate with you about the app, including updates, new features, and promotional offers.
  

Disclosure of your information:

We do not sell or rent your personal information to third parties. We may disclose your personal information to third-party service providers who perform services on our behalf, such as billing services. We may also disclose your personal information if required by law or to protect our legal rights.

Security:

We take reasonable measures to protect your personal information from unauthorized access, use, or disclosure. However, please be aware that no security measures are perfect, and we cannot guarantee the security of your personal information. To help us protect Personal Data, we encourage

you to use a strong password, protect that password from unauthorized use and not use the same log-in credentials (e.g. password) for your Command Bridge account as you do with other services or accounts. All customer data is securely hosted on Google Cloud Platform (GCP) and Amazon Web Services (AWS) in the U.S. All user data is being processed in the United States. Please do not provide any personal information that you can’t afford to have exposed should there be a security incident/breach.

GCP and AWS certifies their physical security with comprehensive compliance and controls, including allowing physical access to personnel with a validated business need, logged and monitored access, electronic surveillance and professional security personnel at all datacenter entry points.

GCP and AWS is accredited against multiple security industry certifications including ISO27001. More details are available from the GCP and AWS websites.

Each and every connection made is end-to-end encrypted over HTTPS. Command Bridge forces HTTPS for all services, including our public website. Data is stored in encrypted form using state-of-the-art encryption.

Payment methods are provided by Stripe, a trusted partner. We do not separately host or store any payment data outside of Stripe.
